Parties

As ARDE YAZILIM ARASTIRMA VE GELISTIRME PAZARLAMA ANONIM SIRKETI ('Arde Yazilim' or 'We'), we attach importance to the protection of your personal data. We would like to inform you about our activities in which we process your personal data with this Clarification Text ('Text').

This Text is also an integral part of the Arde Software User Agreement between the cSight application of Arde Software and the website https://csight.co/ (website and mobile applications will be referred to as 'Platforms' together).

DATA COLLECTION AND PERSONAL DATA CATEGORIES

Arde Software collects the information you voluntarily share with us when using the Platforms and the information obtained automatically when using the services on the Platforms, in accordance with the purposes specified in the Text, only to the extent permitted by law.

Arde Software collects the following data from you.

  • Name (username)

  • E-mail

  • Device ID

  • Transaction Information

  • Profile Picture

    • Application Data: If you use our Apps, we may also collect the following information if you choose to give us access or permission:

    • Geolocation Information: We may request access or permission to track location-based information from your mobile device on an ongoing basis to provide certain location-based services or when you use our mobile applications. If you wish to change our access or permissions, you can do so through your device's settings.

    • Mobile Device Data: We automatically collect device information (such as your mobile device ID, model and manufacturer), operating system, version information and system configuration information, device and application identification numbers, browser type and version, hardware model, Internet service provider and/or your mobile carrier, and Internet Protocol (IP) address (or proxy server). If you use our Apps, we may also collect information about the telephone network associated with your mobile device, the operating system or platform of your mobile device, the type of mobile device you use, the unique device ID of your mobile device, and information about push notifications.

    • Push notifications: We may request to send you push notifications regarding your account or certain features of the application. If you wish to opt-out of receiving such communications, you can turn them off in your device's settings.

    • Profile Picture Data: Our app allows users to upload profile pictures for personalisation purposes. We collect and process this picture data solely for the purpose of displaying the user's selected profile picture within the app. We do not store users' personal pictures on our servers beyond the time required to process and display them as profile pictures. We do not share users' profile pictures with third parties and we do not use the pictures for any purpose other than the purpose of displaying them within the application. Users can remove, update or change their profile pictures from within the app at any time. If you wish to exercise any of your rights or if you have any questions or concerns regarding the processing of your profile picture data, please contact us at info@csight.co.

    • Marketing Information: Conversations and correspondence between Arde Software and the User via telephone and e-mail, communication history, shopping history information, survey, cookie records, information obtained through campaign work, etc.

    • All personal information you provide to us must be accurate and complete. You should inform us in case of any changes in your personal information.

Purposes and Legal Grounds for Processing Personal Data

Your personal data are processed by us for the purposes listed below in accordance with the principles in Article 4 of the Personal Data Protection Law No. 6698 ('KVKK') and based on the legal reasons listed in Articles 5 and 6.

Legal Reasons within the Scope of Article 5/2 of the LPPD

  1. a) expressly provided for by law

    • Providing Information to Authorised Persons, Institutions and Organisations

  2. c) Processing of personal data of the parties to a contract is necessary, provided that it is directly related to the conclusion or performance of the contract.

    • Execution of After Sales Support Services for Goods/Services

    • Execution of Communication Activities

    • Execution of Financial and Accounting Affairs

    • Follow-up of Requests/Complaints

  3. ç) It is mandatory for the data controller to fulfil its legal obligation.

  4. e) Data processing is necessary for the establishment, exercise or protection of a right.

  5. f) Data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

Your personal data will be transferred abroad with your 'explicit consent' due to the fact that the infrastructure and databases of the IT Systems we use for the purposes of carrying out communication activities and storing your data securely are located abroad.

You may withdraw your explicit consent to the processing of your personal data at any time without any restriction or loss. You can send your requests for this to info@csight.co.

Data Collection Method

In order to fulfil the purposes specified in this Text, your personal data are processed by the relevant person by filling out the forms on our Platforms, answering the questionnaires, transmitting them via other websites, sending e-mail messages, by mail, via the relevant documents you send to us, contacting us via the call centre or our phone number, contacting us via social media platforms, subscribing to our newsletter and notifications sent by authorized public institutions and through cookies, based on the legal reason specified in 5 (2) of the KVKK.

Storage and Accuracy of Personal Data

Arde Software will not share personally identifiable information with third parties for marketing purposes without your consent. In line with the provisions of both the Constitution and the Law on the Protection of Personal Data, Arde Software shows the utmost care and attention to the sharing of personal data with domestic and / or foreign countries and continues its activities in accordance with the current regulations in this context.

Your personal data will be transferred for the following purposes without seeking the explicit consent of the person concerned in accordance with Article 8 (2) (a) of the KVKK:

  • In order to fulfil legal obligations in accordance with the relevant legislation, it may be shared with authorised public institutions and organisations if necessary or upon request.

  • It may be shared with our suppliers for the purposes of carrying out financial and/or accounting affairs and carrying out after-sales processes of goods/services.

  • It may be shared with our lawyers as much as necessary within the framework of the confidentiality obligation in order to follow legal processes.

  • Some of the data collected by cSight may be shared with other users in order to display your profile. The scope of the information to be displayed in your profile will be determined by you.

  • External websites and companies that are our service providers may access your personally identifiable information through links on the platforms. These websites and companies are outside the scope of this Text and cannot be applied to these websites and companies. Please refer directly to the privacy policy of the relevant websites and companies.

Transfer of Personal Data Abroad

Information and communication technology applications and software ('IT Systems') (... e-mail software, Amazon-Cloud systems) will be used in the conduct of our business activities. The infrastructure and databases of these services are located abroad.

Observing the Rights of the Data Subject

Pursuant to Article 11 of the KVKK, the relevant persons;

  • To learn whether their personal data is being processed,

  • Request information if personal data has been processed,

  • To learn the purpose of processing personal data and whether they are used in accordance with their purpose

  • To know the third parties to whom personal data are transferred domestically or abroad,

  • To request correction of personal data in case of incomplete or incorrect processing and to request notification of the transaction made within this scope to third parties to whom personal data is transferred,

  • To request the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7 of the Law (in the event that the reasons requiring the processing of personal data disappear, although it has been processed in accordance with the provisions of the Law and other relevant laws) and to request notification of the transaction made within this scope to third parties to whom personal data is transferred,

The exceptions stipulated in Article 28 of the Law are reserved.

In addition to the rights specified in Article 11 of the KVKK, we remind you that if you give explicit consent to the processing of your personal data, you have the right to withdraw such explicit consent at any time.

Implementation and Enforcement

This Clarification Text is published in the cSight application released by Arde Software and on the website https://csight.co/ and is effective as of the date of publication.

Arde Software may make changes or updates in line with legal regulations and company policies. All these changes and updates will be notified to you via our Platforms.

Security and Vulnerability Reporting

As Arde Software, we have taken the necessary technical and administrative measures regarding the security of your personal data. However, if you notice any problems regarding the security of your data, please notify us.

In the message you will send to us in this regard; send an e-mail to info@csight.co, including your contact information and your name, explaining the details of the security vulnerability, what we need to do to see or verify this vulnerability exactly.
